Smoke Alarm Rules for Rental Properties in Victoria โ What Mornington Peninsula Landlords Must Know
June 9, 2026 ย ยทย Impulse Electrical Contractors
If you own a rental or holiday property on the Mornington Peninsula โ in Sorrento, Portsea, Rye, Blairgowrie, or anywhere between Frankston and Flinders โ smoke alarm compliance is not optional. Victoria has strict rules, and the penalties for non-compliance are serious.
This guide explains exactly what the law requires, what's changed in recent years, and what Peninsula landlords need to do to stay compliant and protect their tenants (and themselves).
Victorian Smoke Alarm Law โ The Basics
Under the Residential Tenancies Act 1997 and associated regulations, Victorian landlords must ensure smoke alarms are installed, working, and maintained. The specific requirements are:
- ๐ Smoke alarms must be installed on every storey of the property
- ๐ Alarms must be located in corridors between bedrooms and the rest of the dwelling
- ๐ In properties without a bedroom corridor, an alarm is required inside or near each bedroom
- ๐ Alarms must comply with Australian Standard AS 3786
- ๐ Alarms must be tested and cleaned regularly
- ๐ Batteries must be replaced as required
- ๐ Non-functioning alarms must be replaced immediately
Hardwired vs Battery Alarms โ Which Do You Need?
For rental properties in Victoria, the type of alarm depends on the building:
New Buildings (from 1 August 1997)
Any home built after 1 August 1997 must have hardwired, 240V smoke alarms with a battery backup. These are permanently installed by a licensed electrician and are the gold standard for rental properties.
Older Properties
Older homes (and many on the Peninsula are old) may have battery-only alarms. These are still acceptable for existing tenancies, but we strongly recommend upgrading to hardwired interconnected alarms when a tenancy changes or when any renovation work is done. Interconnected alarms sound together โ if one detects smoke, they all go off.
Landlord Obligations โ What You Must Do
As a Victorian landlord, your obligations are:
- โ Install compliant smoke alarms before a tenant moves in
- โ Test and clean alarms at the start of each tenancy
- โ Replace batteries before each new tenancy begins
- โ Repair or replace faulty alarms within 2 business days of being notified
- โ Replace alarms that are more than 10 years old
Penalties for Non-Compliance
Don't take this lightly. In Victoria, a landlord who fails to install or maintain smoke alarms can face:
- โ ๏ธ Fines of up to $1,652 per offence (as of 2026)
- โ ๏ธ Liability in the event of a fire โ potentially including injury or death claims
- โ ๏ธ Breach of duty notices from Consumer Affairs Victoria
- โ ๏ธ Insurance claims being denied if non-compliance contributed to loss
More importantly: a working smoke alarm can be the difference between life and death. The cost of compliance is minimal compared to the risk.
Holiday Rental Specific Rules โ Big Issue on the Peninsula
The Mornington Peninsula has one of the highest concentrations of holiday rentals in Victoria. From Airbnbs in Sorrento to holiday homes in Portsea, Blairgowrie, and Rye โ if you're renting your property short-term, you have the same smoke alarm obligations as a standard landlord, possibly stricter.
For short-stay accommodation (under 30 days), regulations have tightened. Airbnb and Stayz hosts on the Peninsula need to:
- ๐ก Have compliant smoke alarms on every level of the property
- ๐ก Ensure alarms are working before each guest check-in
- ๐ก Have alarms interconnected (ideally) so any alarm triggers all
- ๐ก Be able to demonstrate compliance if audited by council or Consumer Affairs Victoria
- ๐ก Ensure fire escape routes are clear and signposted if it's a larger property
We service a large number of Peninsula holiday rental properties โ many owners book us once a year for a full compliance check before the summer season.

Frequently Asked Questions
How often should I replace smoke alarms in a rental property?
Australian Standards recommend replacing photoelectric smoke alarms every 10 years. The manufacture date is usually printed on the back of the unit. If you don't know when your alarms were installed, it's safest to replace them โ especially in older Peninsula homes.
Is the tenant responsible for testing smoke alarms?
In Victoria, tenants are responsible for replacing batteries during a tenancy and for testing alarms regularly. However, the landlord must ensure alarms are in working order at the start of each tenancy. We recommend landlords do a documented check at the start of every tenancy.
Do I need a licensed electrician to install hardwired smoke alarms?
Yes. Hardwired 240V smoke alarms must be installed by a licensed electrician. Battery-only alarms can technically be self-installed, but we recommend professional installation to ensure correct placement and compliance.
What's the difference between ionisation and photoelectric alarms?
Victoria regulations require photoelectric (optical) alarms โ not ionisation type. Photoelectric alarms are better at detecting slow, smouldering fires (the most common type in homes). Ionisation alarms respond faster to fast-flaming fires but can be triggered by cooking smoke. For rentals and holiday homes, always use photoelectric alarms.
